A gennaio, un tribunale distrettuale aveva negato la richiesta di estradizione degli Stati Uniti, citando lo stato mentale vulnerabile dell’editore e la possibilità che si sarebbe tolto la vita se fosse stato sottoposto a brutali condizioni carcerarie negli Stati Uniti.

L’Alta Corte si è detta soddisfatta delle assicurazioni dell’avvocato statunitense in quanto le cosiddette misure amministrative speciali (SAM) non sarebbero state applicate ad Assange una volta prigioniero negli Stati Uniti. Un precedente rifiuto di estradarlo era parzialmente giustificato dal fatto che poteva essere sottoposto a SAM. Il team statunitense ha sostenuto durante le udienze d’appello che se la parte americana avesse saputo che si trattava di questo problema, avrebbe offerto assicurazioni contrarie durante il processo originale.
I SAM sono restrizioni speciali che il sistema carcerario statunitense può ordinare per i detenuti ritenuti pericolosi. Includono l’isolamento dagli altri prigionieri in una struttura di massima sicurezza. I critici dicono che sono disumanizzanti e in alcuni casi possono costituire una tortura psicologica.
Assange si trova in varie forme di isolamento dal giugno 2012, quando si è rifugiato presso l’ambasciata ecuadoriana a Londra.
