Nella sentenza si legge: “non è riuscito a impedire che i crimini di omicidio e trattamento inumano venissero commessi … e anche ad agire in modo tale che gli autori di questi crimini fossero puniti”.
Gli avvocati della difesa durante il processo hanno sostenuto che il generale “non aveva alcun controllo effettivo sull’unità”. L’avvocato Nermin Mulalic ha dichiarato che “I membri del distaccamento [El-Mujahid] avevano la loro bandiera e stemma … mobilitazioni e trasferimenti nel distaccamento non furono effettuati come in altre unità dell’esercito [RBIH] (Esercito della Repubblica di Bosnia ed Erzegovina). Alla difesa non resta che provare a ribaltare la sentenza in appello.
